Cow slaughter not allowed, but beef lovers can consume meat in Maharashtra

MUMBAI:-People who want to consume cow meat in Maharashtra can now consume it, as the Bombay high court on Friday struck down two provisions of the Maharashtra Animal protection Act, 1976. Firstly the Act forbids import of beef, and other criminalises possession of beef.
Beef consumers can now import cow meat from other states or countries. Justice Abhay Oka and Justice SC Gupte held that section 5 (d) which forbids possession of beef, violated right to privacy - right to choice of food, guaranteed under Article 21 of the Constitution of India. It held section 9 (b) also as unconstitutional and struck down both the provisions. A lot of applications were filed in Mumbai high court challenging constitutional validity of various provisions of the Maharashtra Animal Protection Act, 1976 which were introduced by 1995 amendment, but brought into force 20 years later - in March 2015. Section 5(d) protection possession of beef imported from other states, and Section 9(b) which fines possession of beef by providing imprisonment of up to one year and a fine of Rs 2,000, which are seen to impose indirect restrictions on beef eating. The senior advocate had expressed his statement that in several states there was restriction on slaughter of cows, bulls along with bullocks, but there was no forbid on import of beef from other states, and thus what section 5(d) seeks to do is to curtail the fundamental right of choice of food of citizens, covered under the right to liberty guaranteed by Article 21 of the Constitution of India. “Let’s not look at the Act something done to harass people,” advocate General Shrihari Aney had said. He said the restrictions on possession was only incidental to the purpose of the enactment and what is central purpose of the act is to prohibit slaughter to fulfill the goal enshrined in Article 48A of the Constitution of India, which demands protection of cows and calves, and to fulfill the duty of the State imposed by Article 51(a)(g) which makes it a duty of every individual to have compassion towards living creatures.
